Indirect non-financial contributions may be in the form of caring for the children, overseeing the children’s education and enrichment, looking after the household’s needs, caring for the family, assisting in household chores, caring for any elderly or infirm relative or dependent of either party, and assisting or supporting the other party in their occupation. The Court will calculate the average of the direct and indirect contribution ratios to determine the Parties’ overall contribution ratio. The Court will then divide the matrimonial assets using this overall contribution ratio. Depending on the facts and circumstances of each case, the direct and indirect contribution ratios may not be accorded equal weight in the determination of the overall contribution ratio. 1. Indirect contributions may be accorded more weight in long marriages with children in comparison to short marriages without any children. 2. Where the pool of matrimonial assets is extremely large and is accrued by one Party’s exceptional efforts, with little to no contribution from the other Party, direct contributions may be accorded more weight.

If there is no agreement about the value of a particular asset during a property settlement, the asset will need to be valued. In family law matters in the Federal Circuit and Family Court (FCFCA), the rules require that evidence about a particular issue, such as the value of a property, be given by a single expert witness. Some of the reasons for this requirement include minimising cost, and maximising efficiency. If there are two separate experts, giving different valuations of one asset, it is difficult for the court to determine which value should be adopted. Additionally, the parties to the court proceeding can split the cost of a single expert, rather than each paying the whole cost of their own expert. The single expert can be appointed by agreement between the separating couple, or by order of the court if there is no agreement. The expert must be willing to accept the appointment. The single expert is instructed by both sides to the dispute.

The book thus covers only a small portion of the field of English style. There are very limited circumstances under which a Virginia court might set aside or modify a property settlement agreement. One common ground is if there was fraud, duress, or unconscionability during the formation of the agreement. For instance, if one spouse hid substantial assets, or if one spouse was coerced into signing the agreement against their will, a court might intervene. However, proving these circumstances is a high bar. You can’t just claim you didn’t understand it or that you regret the terms later on. Courts look for clear evidence of wrongdoing or extreme unfairness at the time the agreement was made. Another potential, albeit rare, avenue for modification exists if the agreement itself contains a provision for future modification. For example, some agreements might specify that spousal support can be reviewed under certain conditions, such as a significant change in income for either party. But absent such a specific clause within the agreement, property division terms are typically non-modifiable. That means once the house is divided, the bank accounts split, and the retirement funds allocated, those decisions are usually permanent.

Decisions must be made about the family home, vacation homes, investment properties, vehicles, and valuable personal property. You’ll need clarity about whether to sell properties and divide proceeds or have one party buy out the other’s interest. Retirement accounts, pensions, and investments accumulated during the marriage or relationship are subject to division. A qualified domestic relations order (QDRO) may be necessary for retirement accounts to ensure they are divided properly without negative tax implications. Clearly outlining responsibility for debts like mortgages, car loans, credit cards, and personal loans protects your credit and financial future. In some cases, one party may require financial support from the other following separation or divorce. A PSA will detail the terms, duration, and conditions of these payments.
